In Re AB. 468 - Dixie Sexual Education Act of 2020

In Re AB. 468 - Dixie Sexual Education Act of 2020 was a decision of the Dixie Supreme Court relating to the constitutionality of mandatory sexual education curriculum without religious exemptions under the First Amendment and Fourteenth Amendment to the United States Constitution. Associate Justice Dewey Cheatem, writing for a unanimous court, rejected the claims. Cheatem declared that "there is no fundamental right to dictate school curriculum" and that the First Amendment's free exercise clause "does not guard against ideas with which one disagrees." Though the court applied strict scrutiny as to the free exercise claim, he again found that the statute was narrowly tailored to advance a compelling government interest in protecting the health, safety, and liberty of children.
